Mr. Marx has had a long and distinguished career in labor-management and employee relations with over two decades of experience in providing advice and counsel on every aspect of employment law, including, but not limited to, grievances, appeals, conduct and performance based action cases. He has advised hundreds of clients and litigated numerous employee and labor relations issues and problems, representing management in collective bargaining and in settlement negotiations in a wide variety of labor and employment disputes. He has created and implemented innovative dispute resolution procedures, while also serving in a neutral role. Many of his clients are high profile organizations and individuals, and he has extensive experience in handling controversial matters. He is a national lecturer on employment, ADA, and labor law and appears regularly on WUSA (Washington, DC). His views on employment law have been quoted in the New York Times, the Washington Post, the Wall Street Journal, and ABC’s Nightly News.
Representative Accomplishments
Mr. Marx’s accomplishments include:
§ Investigating on behalf of clients a wide variety of claims of discrimination (including, but not limited to, claims of sexual harassment) and preparing reports for clients on the results of such investigations.
§ Advising employers on employment law compliance, on topics such as Title VII, Section 504, ADA, the Fair Labor Standards Act; and the Age Discrimination In Employment Act.
§ Training of supervisors in both the private and public sector on a variety of employment law topics, including, but not limited to, sexual harassment law and the ADA/Rehabilitation Act.
§ Performing an extensive diversity study for the Department of Homeland Security.
§ Performing employment law audits for employers, and drafting employment law polices and handbooks for numerous major for-profit and non-profit employers.
§ Representing management in collective bargaining negotiations and in labor grievances and arbitrations, creating dispute resolution programs for major employers, and settling numerous employment disputes.
§ Reviewing position discriminations and employee evaluations for employment law issues, and providing training for public and private sector employers on a variety of employment law issues.
§ Creating The Management Channel, an innovative Internet based tool for advising employers on employment law topics.
§ Defending employers (including high profile labor organizations, government officials, think tanks and professional firms) in numerous employment litigation matters.
§ Preparing memoranda for clients on complex employment law and HR issues.
§ Representing pro bono a class of government employees against a Federal agency in a major civil rights case.
§ Representing government employees in litigation relating to retirement issues, wrongful terminations, and discrimination.
§ Author of the Disability Law Compliance Manual, 2nd Ed. (updated bi-yearly) and the Disability Law Compliance Report (monthly) from 1991 to present, co-editor of HR Management Reporter, Commentator on Modern Personnel Form, and contributor to Personnel Directors Legal Guide.
Background Information
Mr. Marx co-founded Marx and Lieberman in 1998 and its predecessor firm, Marx and Krame in 1986. Mr. Marx has an LL.M. from the Georgetown University Law Center and a J.D. from the Washington and Lee School of Law, where he was an executive editor of the Law Review. He graduated Magna Cum Laude and Phi Beta Kappa from Washington University in St. Louis.
